The Company provides access to online courses, discussion groups, instructional media, tools, and digital materials for educational and informational purposes (collectively, including any new features, the "Service") through our primary website located at www.asbeinvest.com (including all sub-domains therein) (the "Site").

By purchasing, accessing, subscribing to, or using the Site and/or Service, you agree to be bound by and comply with all the terms, conditions, and provisions set forth herein, as well as the Company's Privacy Policy. Please read these Terms and Conditions carefully before using the Service. If you do not agree to any part of these terms, you must immediately cease all access and use of our Site and Service.

5. Access and Use of the Service

• Personal, Non-Commercial Use: Upon your purchase of the Service, the Company grants you a limited, non-exclusive, non-transferable, and revocable licence to access and view the content solely for your personal educational and informational purposes. Commercial exploitation of any content is strictly prohibited.
• Prohibition on Sharing and Redistribution: Your user account is personal to you. You are strictly prohibited from disclosing your login credentials (Username and Password) or sharing your account with any other person. • Technical Restrictions: You agree to access the content only through the interfaces provided by the Company. • No Refund Policy: All purchases and subscriptions are final. Because access to the digital content is delivered to you immediately upon the completion of your purchase, you are not entitled to any refund (whether partial or full), unless expressly stated otherwise in the specific policy of a particular course.

6. Recurring Subscriptions

If you purchase a subscription plan, the Service will be provided on an automatically renewing basis ("Recurring Subscription"). You authorize the Company to automatically charge your selected payment method at the end of each billing cycle until the subscription is canceled by you or us.

• Price Adjustments: We reserve the right to adjust subscription rates. We will provide advance notice of any price changes. If you do not agree to the new rate, you must cancel your subscription before the next scheduled billing date.
• Cancellation: You may cancel your Recurring Subscription at any time through your account settings on the Site or by contacting support. Following cancellation, you will continue to have access to the Service until the end of your current paid billing period. No refunds or credits will be provided for partially used billing periods.
• Failed Payments: If we are unable to successfully charge your payment method, the Company reserves the right to suspend your access to the Service immediately until full payment is received.

7. User Conduct and Restrictions

You explicitly agree that you will not use the Service to, or engage in, any of the following activities:

• Screen Recording and Copying: Capturing screenshots, recording video, or recording audio while accessing or using the Company's courses or digital content is strictly prohibited.
• Data Scraping and Automated Bots: Utilizing data mining, robots, spiders, scraping, or similar data gathering or extraction methods to harvest content or structural data from the Site is strictly forbidden.
• Bypassing Security: Using VPNs, proxies, IP masking, or any other technical measures to disguise your identity or circumvent an IP block imposed by the Company.
• Unlawful Activity: Uploading, posting, or transmitting any content that infringes upon the intellectual property rights of others, contains software viruses, or is obscene, threatening, defamatory, or otherwise violates the laws of Thailand.
• Non-Competition: Engaging in any advertising, promotional, or soliciting activities on the Site or within our discussion groups that compete, directly or indirectly, with the business, products, or services of the Company.

If you breach any of these provisions, the Company reserves the right to terminate your access, close your account, and/or pursue legal remedies to the fullest extent of the law, without any obligation to refund any fees paid.

8. Intellectual Property Rights

All content, software, videos, images, text, branding, trademarks, and other intellectual property rights appearing on the Site and Service are the sole property of Asbe invest, operated and managed by Elata Co., Ltd.. (or are used under legitimate licence). Your access to the Service does not transfer any ownership, title, or interest in such intellectual property to you.

For any user content or feedback you post within our discussion groups or on the Site, you grant the Company a non-exclusive, royalty-free, perpetual, and worldwide licence to copy, modify, distribute, or display such content for promotional or educational purposes (including publishing your testimonials), subject to applicable data protection laws.

9. Limitation of Liability

To the maximum extent permitted under the laws of Thailand, the Company, its affiliates, directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including but not limited to loss of profits, trading losses, loss of data, or business interruption) arising out of the use or the inability to use the Site or Service, even if the Company has been advised of the possibility of such damages. If you are dissatisfied with any portion of the Service, your sole and exclusive remedy is to discontinue using the Service.

10. Termination

The Company may, at its sole discretion, suspend or terminate your account or use of the Service, and remove any content, for any reason, including lack of use or if we believe you have violated these Terms and Conditions. Any suspected fraudulent, abusive, or illegal activity may be referred to appropriate law enforcement authorities in Thailand. Upon termination, your right to use the Service will immediately cease, and the Company will not provide any refund.

11. Severability and No Waiver

• Severability: If any provision or part of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that part shall be deemed severable, and the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
• No Waiver: Our failure to enforce or exercise any right or provision of these terms shall not constitute a waiver of such right or provision in the future.

12. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the Kingdom of Thailand. Any disputes, controversies, or claims arising out of or in connection with these terms shall be submitted exclusively to the jurisdiction of the Thai Courts.
